1. Scope and Purpose

This User‑Generated Content (UGC) & Copyright Policy (“Policy”) governs all content created, uploaded, transmitted, or otherwise made available by users (“User Content”) on the All me platform (“Service”). This Policy forms an integral part of the Terms of Use and applies to all users without exception.

2. Ownership of User Content

2.1 Users retain full ownership and all intellectual property rights in the content they create and upload to the Service.

2.2 By submitting User Content, users grant All me a limited, non‑exclusive, revocable, and strictly purpose‑bound licence to store, process, and display such content solely for the operation of the Service and in accordance with the user’s privacy settings.

2.3 All me does not claim ownership over User Content and does not use User Content for advertising, profiling, or commercial exploitation.

3. User Responsibilities for UGC

3.1 Users are solely responsible for ensuring that their User Content:

• complies with Swiss law, including copyright, personality rights, and the Swiss Criminal Code
• does not infringe the rights of third parties
• does not violate privacy, confidentiality, or data protection obligations
• does not contain illegal, harmful, or prohibited material as defined in the Community Guidelines

3.2 Users warrant that they have all necessary rights, permissions, and licences to upload and share their User Content.

3.3 Users agree not to upload or distribute content that they do not have the legal right to use, including copyrighted works, trademarks, or proprietary materials belonging to others.

4. Copyright and Intellectual Property Compliance

4.1 Users must respect all applicable copyright and intellectual property laws. Uploading copyrighted material without permission is strictly prohibited.

4.2 Users may only upload:

• original content they created
• content for which they hold the necessary rights
• content that is in the public domain
• content used under a valid licence (e.g., Creative Commons), provided licence terms are followed

4.3 Users must not remove, obscure, or alter copyright notices, watermarks, or attribution requirements.

5. Republishing and External Dissemination

5.1 The All me platform is a private community. User Content is not intended for public distribution unless explicitly made public by the user.

5.2 Any republication, redistribution, or external dissemination of content originating from this private community is undertaken solely at the responsibility of the individual republishing it.

5.3 All me accepts no liability for any legal, civil, regulatory, or reputational consequences arising from such republication, including but not limited to:

• copyright infringement
• privacy violations
• defamation
• misuse of personal data
• breach of confidentiality

6. Prohibited Uses of UGC

Users may not upload, share, or distribute content that:

• infringes copyright or intellectual property rights
• violates privacy or data protection laws
• contains personal data of others without consent
• includes non‑consensual intimate imagery
• breaches contractual or confidentiality obligations
• impersonates others or misrepresents authorship

7. Notice‑and‑Takedown Procedure

7.1 All me complies with Swiss legal obligations regarding unlawful content and copyright infringement.

7.2 Rights holders or affected individuals may submit a takedown request containing:

• identification of the infringing content
• evidence of ownership or rights
• contact information
• a statement of good‑faith belief that the use is unauthorised

7.3 Upon receiving a valid notice, All me will act expeditiously and proportionately to:

• restrict access to the content
• remove the content
• notify the user responsible
• request counter‑evidence where appropriate

7.4 Users may submit a counter‑notice if they believe the removal was in error.

8. Data Protection and Human Rights Considerations

8.1 All me processes User Content in accordance with the revDPA and the principles of necessity, proportionality, and privacy by default.

8.2 All moderation and enforcement actions are carried out in a manner consistent with the UDHR, including:

• the right to privacy (Art. 12)
• the right to freedom of expression (Art. 19)
• the right to dignity and non‑discrimination (Art. 1–2)

8.3 Content moderation decisions are made by human reviewers and are never based on automated profiling.

9. Indemnification

Users agree to indemnify and hold harmless All me, its operators, and service providers from any claims, damages, or liabilities arising from:

• their User Content
• their infringement of intellectual property rights
• their republication or external dissemination of content
• their violation of privacy or data protection laws

10. Termination and Enforcement

All me may restrict, suspend, or terminate accounts that repeatedly or seriously violate this Policy or applicable law. Enforcement actions are proportionate and respect user rights.

1. Geltungsbereich und Zweck

Diese Richtlinie für nutzergenerierte Inhalte (UGC) & Urheberrecht („Richtlinie“) regelt alle Inhalte, die von Nutzern („Nutzerinhalte“) auf der All me Plattform („Dienst“) erstellt, hochgeladen, übertragen oder anderweitig verfügbar gemacht werden. Diese Richtlinie ist ein integraler Bestandteil der Nutzungsbedingungen und gilt ausnahmslos für alle Nutzer.

2. Eigentum an Nutzerinhalten

2.1 Nutzer behalten das vollständige Eigentum und alle geistigen Eigentumsrechte an den Inhalten, die sie im Dienst erstellen und hochladen.

2.2 Durch das Einreichen von Nutzerinhalten gewähren Nutzer All me eine begrenzte, nicht-exklusive, widerrufbare und strikt zweckgebundene Lizenz, diese Inhalte ausschließlich zum Betrieb des Dienstes und gemäß den Datenschutzeinstellungen des Nutzers zu speichern, zu verarbeiten und anzuzeigen.

2.3 All me erhebt keinen Anspruch auf Eigentum an Nutzerinhalten und verwendet Nutzerinhalte nicht für Werbung, Profiling oder kommerzielle Verwertung.

3. Pflichten der Nutzer für UGC

3.1 Nutzer sind allein dafür verantwortlich sicherzustellen, dass ihre Nutzerinhalte:

• mit schweizerischem Recht übereinstimmen, einschließlich Urheberrecht, Persönlichkeitsrechten und dem Schweizer Strafgesetzbuch
• die Rechte Dritter nicht verletzen
• keine Datenschutz-, Vertraulichkeits- oder Geheimhaltungspflichten verletzen
• kein illegales, schädliches oder verbotenes Material enthalten, wie in den Community-Richtlinien definiert

3.2 Nutzer gewährleisten, dass sie alle erforderlichen Rechte, Genehmigungen und Lizenzen besitzen, um ihre Nutzerinhalte hochzuladen und zu teilen.

3.3 Nutzer stimmen zu, keine Inhalte hochzuladen oder zu verbreiten, für die sie kein gesetzliches Nutzungsrecht besitzen, einschließlich urheberrechtlich geschützter Werke, Marken oder proprietärer Materialien anderer.

4. Einhaltung von Urheberrecht und geistigem Eigentum

4.1 Nutzer müssen alle geltenden Urheberrechts- und Gesetze zum geistigen Eigentum respektieren. Das Hochladen urheberrechtlich geschützten Materials ohne Erlaubnis ist strikt untersagt.

4.2 Nutzer dürfen nur folgende Inhalte hochladen:

• Originalinhalte, die sie selbst erstellt haben
• Inhalte, für die sie die erforderlichen Rechte besitzen
• Inhalte, die gemeinfrei sind
• Inhalte, die unter einer gültigen Lizenz (z. B. Creative Commons) verwendet werden, sofern die Lizenzbedingungen eingehalten werden

4.3 Nutzer dürfen keine Urheberrechtshinweise, Wasserzeichen oder Anforderungen zur Namensnennung entfernen, verschleiern oder verändern.

5. Wiederveröffentlichung und externe Verbreitung

5.1 Die All me Plattform ist eine private Gemeinschaft. Nutzerinhalte sind nicht für die öffentliche Verbreitung bestimmt, es sei denn, der Nutzer macht sie ausdrücklich öffentlich.

5.2 Jede Wiederveröffentlichung, Weiterverbreitung oder externe Verbreitung von Inhalten aus dieser privaten Gemeinschaft erfolgt ausschließlich in der Verantwortung der Person, die sie erneut veröffentlicht.

5.3 All me übernimmt keine Haftung für rechtliche, zivilrechtliche, regulatorische oder reputationsbezogene Folgen, die aus einer solchen Wiederveröffentlichung entstehen, einschließlich, aber nicht beschränkt auf:

• Urheberrechtsverletzungen
• Verletzungen der Privatsphäre
• Verleumdung
• Missbrauch personenbezogener Daten
• Verletzung der Vertraulichkeit

6. Verbotene Nutzungen von UGC

Nutzer dürfen keine Inhalte hochladen, teilen oder verbreiten, die:

• Urheberrechte oder geistige Eigentumsrechte verletzen
• Datenschutz- oder Datenschutzgesetze verletzen
• personenbezogene Daten anderer ohne deren Zustimmung enthalten
• nicht-einvernehmliche intime Bilder enthalten
• vertragliche oder vertrauliche Verpflichtungen verletzen
• andere imitieren oder die Urheberschaft falsch darstellen

7. Verfahren zur Meldung und Entfernung

7.1 All me erfüllt die schweizerischen gesetzlichen Verpflichtungen in Bezug auf rechtswidrige Inhalte und Urheberrechtsverletzungen.

7.2 Rechteinhaber oder betroffene Personen können eine Meldung zur Entfernung einreichen, die Folgendes enthält:

• Identifikation des verletzenden Inhalts
• Nachweis des Eigentums oder der Rechte
• Kontaktinformationen
• eine Erklärung des guten Glaubens, dass die Nutzung unautorisiert ist

7.3 Nach Erhalt einer gültigen Meldung wird All me unverzüglich und verhältnismäßig handeln, um:

• den Zugriff auf den Inhalt einzuschränken
• den Inhalt zu entfernen
• den verantwortlichen Nutzer zu benachrichtigen
• gegebenenfalls Gegenbeweise anzufordern

7.4 Nutzer können eine Gegenmeldung einreichen, wenn sie glauben, dass die Entfernung irrtümlich erfolgt ist.

8. Datenschutz- und Menschenrechtsaspekte

8.1 All me verarbeitet Nutzerinhalte gemäß dem revDSG und den Grundsätzen der Notwendigkeit, Verhältnismäßigkeit und Privacy by Default.

8.2 Alle Moderations- und Durchsetzungsmaßnahmen erfolgen in Übereinstimmung mit der AEMR, einschließlich:

• dem Recht auf Privatsphäre (Art. 12)
• dem Recht auf Meinungsfreiheit (Art. 19)
• dem Recht auf Würde und Nichtdiskriminierung (Art. 1–2)

8.3 Entscheidungen zur Inhaltsmoderation werden von menschlichen Prüfern getroffen und basieren niemals auf automatisiertem Profiling.

9. Freistellung

Nutzer erklären sich damit einverstanden, All me, seine Betreiber und Dienstleister von allen Ansprüchen, Schäden oder Haftungen freizustellen, die entstehen aus:

• ihren Nutzerinhalten
• ihrer Verletzung geistiger Eigentumsrechte
• ihrer Wiederveröffentlichung oder externen Verbreitung von Inhalten
• ihrer Verletzung von Datenschutz- oder Datenschutzgesetzen

10. Kündigung und Durchsetzung

All me kann Konten einschränken, sperren oder kündigen, die diese Richtlinie oder geltendes Recht wiederholt oder schwerwiegend verletzen. Durchsetzungsmaßnahmen sind verhältnismäßig und respektieren die Rechte der Nutzer.

1. Champ d’application et objectif

La présente Politique relative au Contenu Généré par les Utilisateurs (UGC) & au Droit d’Auteur (« Politique ») régit tout contenu créé, téléversé, transmis ou autrement mis à disposition par les utilisateurs (« Contenu Utilisateur ») sur la plateforme All me (« Service »). Cette Politique fait partie intégrante des Conditions d’Utilisation et s’applique à tous les utilisateurs sans exception.

2. Propriété du Contenu Utilisateur

2.1 Les utilisateurs conservent la pleine propriété et tous les droits de propriété intellectuelle sur le contenu qu’ils créent et téléversent sur le Service.

2.2 En soumettant du Contenu Utilisateur, les utilisateurs accordent à All me une licence limitée, non exclusive, révocable et strictement limitée à l’usage prévu pour stocker, traiter et afficher ce contenu uniquement dans le cadre du fonctionnement du Service et conformément aux paramètres de confidentialité de l’utilisateur.

2.3 All me ne revendique aucun droit de propriété sur le Contenu Utilisateur et n’utilise pas le Contenu Utilisateur à des fins publicitaires, de profilage ou d’exploitation commerciale.

3. Responsabilités des utilisateurs concernant l’UGC

3.1 Les utilisateurs sont seuls responsables de s’assurer que leur Contenu Utilisateur :

• est conforme au droit suisse, y compris le droit d’auteur, les droits de la personnalité et le Code pénal suisse
• ne porte pas atteinte aux droits de tiers
• ne viole pas les obligations de confidentialité, de secret ou de protection des données
• ne contient aucun élément illégal, nuisible ou interdit tel que défini dans les directives communautaires

3.2 Les utilisateurs garantissent qu’ils disposent de tous les droits, autorisations et licences nécessaires pour téléverser et partager leur Contenu Utilisateur.

3.3 Les utilisateurs s’engagent à ne pas téléverser ou distribuer de contenu pour lequel ils ne disposent pas des droits légaux d’utilisation, y compris des œuvres protégées par le droit d’auteur, des marques ou des matériaux propriétaires appartenant à des tiers.

4. Conformité au droit d’auteur et à la propriété intellectuelle

4.1 Les utilisateurs doivent respecter toutes les lois applicables en matière de droit d’auteur et de propriété intellectuelle. Le téléversement de matériel protégé par le droit d’auteur sans autorisation est strictement interdit.

4.2 Les utilisateurs ne peuvent téléverser que :

• du contenu original qu’ils ont créé
• du contenu pour lequel ils détiennent les droits nécessaires
• du contenu appartenant au domaine public
• du contenu utilisé sous une licence valide (p. ex. Creative Commons), à condition que les termes de la licence soient respectés

4.3 Les utilisateurs ne doivent pas supprimer, masquer ou modifier les mentions de droit d’auteur, filigranes ou exigences d’attribution.

5. Republier et diffuser à l’extérieur

5.1 La plateforme All me est une communauté privée. Le Contenu Utilisateur n’est pas destiné à une diffusion publique, sauf si l’utilisateur le rend explicitement public.

5.2 Toute republication, redistribution ou diffusion externe de contenu provenant de cette communauté privée est effectuée uniquement sous la responsabilité de la personne qui le republie.

5.3 All me n’accepte aucune responsabilité pour les conséquences juridiques, civiles, réglementaires ou réputationnelles découlant d’une telle republication, y compris mais sans s’y limiter :

• violation du droit d’auteur
• atteinte à la vie privée
• diffamation
• utilisation abusive de données personnelles
• violation de la confidentialité

6. Utilisations interdites de l’UGC

Les utilisateurs ne peuvent téléverser, partager ou distribuer du contenu qui :

• viole des droits d’auteur ou des droits de propriété intellectuelle
• viole les lois sur la protection de la vie privée ou des données
• contient des données personnelles d’autrui sans consentement
• inclut des images intimes non consensuelles
• viole des obligations contractuelles ou de confidentialité
• usurpe l’identité d’autrui ou falsifie l’attribution d’un contenu

7. Procédure de notification et de retrait

7.1 All me respecte les obligations légales suisses concernant les contenus illicites et les violations du droit d’auteur.

7.2 Les titulaires de droits ou les personnes concernées peuvent soumettre une demande de retrait contenant :

• l’identification du contenu litigieux
• la preuve de la propriété ou des droits
• les informations de contact
• une déclaration de bonne foi indiquant que l’utilisation est non autorisée

7.3 Dès réception d’une notification valide, All me agira rapidement et de manière proportionnée pour :

• restreindre l’accès au contenu
• supprimer le contenu
• informer l’utilisateur responsable
• demander des contre-preuves si nécessaire

7.4 Les utilisateurs peuvent soumettre une contre-notification s’ils estiment que la suppression était erronée.

8. Protection des données et considérations relatives aux droits humains

8.1 All me traite le Contenu Utilisateur conformément au nLPD et aux principes de nécessité, de proportionnalité et de confidentialité par défaut.

8.2 Toutes les actions de modération et d’application sont effectuées conformément à la DUDH, notamment :

• le droit à la vie privée (art. 12)
• le droit à la liberté d’expression (art. 19)
• le droit à la dignité et à la non-discrimination (art. 1–2)

8.3 Les décisions de modération de contenu sont prises par des examinateurs humains et ne reposent jamais sur un profilage automatisé.

9. Indemnisation

Les utilisateurs acceptent d’indemniser et de dégager de toute responsabilité All me, ses opérateurs et ses prestataires de services pour toute réclamation, tout dommage ou toute responsabilité découlant :

• de leur Contenu Utilisateur
• de leur violation des droits de propriété intellectuelle
• de leur republication ou diffusion externe de contenu
• de leur violation des lois sur la protection de la vie privée ou des données

10. Résiliation et application

All me peut restreindre, suspendre ou résilier les comptes qui enfreignent de manière répétée ou grave la présente Politique ou la loi applicable. Les mesures d’application sont proportionnées et respectent les droits des utilisateurs.
